Booking Terms & Conditions

Last updated: September 2026

These Booking Terms and Conditions ("Terms") apply to bookings for XCape238, including event access, accommodation packages, land packages, flight-inclusive packages and any other travel or event services sold by or on behalf of XCape238.

Please read these Terms carefully before making a booking. By submitting a booking and paying a deposit or other payment, you confirm that you have read, understood and agree to these Terms.

Nothing in these Terms affects your statutory rights as a consumer.

1. About Us

XCape238 is operated as:

Legal name: XCape238
Trading name: XCape238

Email: xcapeevents238@gmail.com

Website: xcape238.co.uk

References in these Terms to "XCape238", "we", "us" or "our" mean XCape238.

2. The XCape238 Experience

XCape238 is an adults-only music, entertainment and travel experience scheduled to take place in Cape Verde from 2 June 2027 to 7 June 2027, subject to these Terms.

Depending on the package selected, your booking may include some or all of the following:

  • accommodation;
  • access to XCape238 entertainment and programmed events;
  • access to the Maré and Brisa entertainment venues;
  • all-inclusive food and drinks during advertised service periods;
  • alcoholic drinks for guests legally permitted to consume alcohol;
  • flights, where a flight-inclusive package has been purchased;
  • transfers or other travel services where expressly stated in the booking confirmation; and
  • other services expressly identified in your booking confirmation.

Only services expressly stated as included in your booking are included in the contract.

3. Making a Booking

A booking request is subject to availability.

The person making the booking ("Lead Booker") must be at least 18 years old and must have authority to make the booking on behalf of every person named on it.

The Lead Booker is responsible for:

  • providing complete and accurate information;
  • ensuring all members of the booking receive these Terms and all relevant travel information;
  • ensuring payments are made when due; and
  • communicating with XCape238 regarding the booking.

A contract is formed when we accept the booking and issue a booking confirmation or otherwise confirm acceptance in writing.

We reserve the right to reject a booking before it has been confirmed.

Back to top ↑

4. Prices

Prices are stated per person unless expressly stated otherwise.

Prices advertised on the website may be based on two persons sharing accommodation. Different occupancy arrangements, room categories, flights, departure airports, upgrades or optional services may result in a different price.

Your confirmed price will be shown in your booking confirmation.

We reserve the right to correct an obvious pricing, typographical or booking-system error where it would have been reasonably apparent that an error had occurred.

If an error affects your booking, we will contact you promptly and provide the options required by applicable law.

Back to top ↑

5. Deposits

Unless otherwise stated at the time of booking, a £200 deposit per person is required to secure a place.

5.1 Non-refundable deposit

Subject always to your statutory rights and the remainder of these Terms, the £200 per-person deposit is a non-refundable booking deposit.

If you cancel your booking, decide not to travel, fail to make subsequent payments when due, or otherwise withdraw from your booking for a reason which is not attributable to XCape238, your deposit will normally not be refunded.

The deposit is intended to secure your place and contributes towards the costs, commitments and losses incurred or reasonably expected to be incurred by XCape238 as a consequence of accepting and subsequently cancelling your booking.

Any amount retained following cancellation will remain subject to applicable consumer law. We will not retain an amount which we are not lawfully entitled to retain.

5.2 Cancellation by the promoters

If XCape238 is cancelled by the promoters and is not rescheduled or replaced with an equivalent package or arrangement accepted by you, your deposit and other amounts paid to XCape238 in respect of services which will not be provided will be refunded, subject to any greater rights you have under applicable consumer or package travel law.

This provision does not affect any additional statutory rights that may apply to your booking.

Back to top ↑

6. Payment Plans and Final Balance

Interest-free payment plans may be offered for eligible bookings.

Unless your booking confirmation specifies otherwise, the entire outstanding balance must be paid no later than 30 March 2027.

Payment dates forming part of an agreed payment plan are contractual payment dates.

You are responsible for ensuring payments are made on time.

If a payment is missed, we may contact you and provide a reasonable opportunity to bring the booking up to date where appropriate.

If outstanding amounts remain unpaid, we may cancel the booking in accordance with these Terms and applicable law.

Any amount retained following such cancellation will be limited to amounts we are lawfully entitled to retain.

Back to top ↑

7. Cancellation by You

If you wish to cancel your booking, the Lead Booker must notify us in writing at:

xcapeevents238@gmail.com

Cancellation takes effect when we receive the cancellation request.

Your £200 per-person deposit will normally be non-refundable as explained in Section 5.

Where you have paid amounts exceeding the deposit, any additional cancellation charge or amount retained will be reasonable and will reflect, where applicable:

  • costs already incurred in connection with your booking;
  • amounts which we are contractually required to pay suppliers;
  • cancellation charges imposed by airlines, accommodation providers or other suppliers;
  • the timing of the cancellation;
  • our reasonably anticipated loss resulting from cancellation; and
  • our ability to mitigate that loss, including by reselling the relevant services.

We will not charge or retain sums which applicable consumer or package travel law requires us to refund.

Where applicable package travel legislation applies to your booking, your cancellation rights and any termination fee will also be governed by that legislation.

Back to top ↑

8. Cooling-Off Rights

Consumers should be aware that the ordinary 14-day cancellation right applying to many online purchases does not necessarily apply to accommodation, passenger transport, catering or leisure services provided on a specific date or during a specific period.

Where a statutory cancellation right does apply to a particular service purchased from us, nothing in these Terms removes or restricts that right.

Back to top ↑

9. Transferring Your Booking

Requests to transfer a booking to another person must be made in writing.

Transfers are subject to:

  • applicable law;
  • supplier and airline rules;
  • the replacement traveller satisfying all conditions applicable to the booking;
  • availability and operational requirements; and
  • payment of any reasonable and evidenced costs arising from the transfer.

Where your booking constitutes a package under applicable package travel legislation, your statutory rights relating to transfer of the package will apply.

Back to top ↑

10. Changes Requested by You

Requests to change names, accommodation, flights, room types, dates or other booking details must be submitted in writing.

We cannot guarantee that a requested change can be made.

Where a change is possible, you will be responsible for any reasonable additional supplier charges, fare differences or other costs resulting from your requested change.

We will tell you about such costs before completing the change where reasonably practicable.

Back to top ↑

11. Changes by XCape238

XCape238 is a live entertainment and travel experience. Artists, DJs, performers, running orders, entertainment schedules, venues within the resort, timings and other operational details may need to change.

The advertised music policies for Maré and Brisa describe the intended overall character of those venues and do not constitute a guarantee that any particular genre, DJ, artist or performance will be available at a particular time.

We may make minor or reasonably necessary changes to the programme or arrangements where this does not materially alter the overall experience purchased.

If we are required to make a significant change to a package booking, we will provide the options and remedies required by applicable law.

Depending upon the circumstances, these may include accepting the change, accepting an appropriate alternative where offered, or terminating the contract and receiving any refund required by law.

Nothing in this section allows us to make material changes without providing rights which the law requires us to provide.

Back to top ↑

12. Cancellation by XCape238

We may cancel an event or booking where reasonably necessary, including because of circumstances beyond our control, safety concerns, insufficient participation where a lawful minimum-participation condition has been disclosed, supplier failure or other circumstances permitted by applicable law.

Where XCape238 cancels the event and the contracted services will not be supplied, customers will receive the refunds required by applicable law.

In particular, where the promoters cancel XCape238 and it is not rescheduled or replaced by an arrangement accepted by you, the £200-per-person deposit will be refunded together with other refundable sums paid for services that will not be provided.

Where a booking constitutes a regulated package, cancellation and refund rights under applicable package travel legislation will apply.

13. Flights

13.1 Flight-inclusive packages

Where you purchase an XCape238 package which includes flights, XCape238 will arrange flights with easyJet or another airline, as identified in your booking documentation.

Unless expressly stated otherwise in your booking confirmation, XCape238 will arrange the relevant flights for the purpose of providing them as part of your XCape238 package.

XCape238 is a separate business from easyJet and any other airline used to provide flights.

13.2 Flight details

Flight times, routes, airports, aircraft, operating airlines and schedules may be subject to change.

The flight details applicable to your booking will be provided in your booking confirmation or subsequent travel documentation.

Where easyJet is the operating airline, the flight will also be subject to easyJet's applicable conditions of carriage.

A change to an airline's flight schedule does not automatically constitute cancellation of the XCape238 event.

Where a flight change results in a significant change to a package, your rights will be determined in accordance with applicable package travel and consumer legislation and these Terms.

13.3 Flight cancellations and significant changes

Airlines may occasionally cancel, reschedule or materially change flights for operational, safety, weather, air-traffic-control or other reasons.

If an airline cancels or materially changes a flight forming part of your XCape238 package, we will notify affected customers as soon as reasonably practicable after we become aware of the change.

Where XCape238 has obligations to you under applicable package travel or consumer legislation, we will comply with those obligations.

Where reasonably possible, we may arrange alternative flights or travel arrangements.

Nothing in these Terms removes or restricts any statutory rights you may have as a result of a cancelled or significantly changed flight or package.

13.4 Passenger information

You must provide complete and accurate passenger information when requested.

Passenger names must match the names appearing on the travel documents that will be used for travel.

It is your responsibility to check the passenger details shown on your booking confirmation and notify XCape238 promptly of any error.

Where incorrect information supplied by you results in airline charges, fare differences or other reasonable costs, you will be responsible for those costs to the extent permitted by law.

13.5 Name changes and passenger substitutions

Airlines may impose restrictions or charges relating to passenger name changes or substitutions.

Any request to change a passenger must be submitted to XCape238 as soon as possible.

Where your booking constitutes a package and you have a statutory right to transfer the package to another traveller, that right will apply notwithstanding any other provision of these Terms.

You will be responsible for reasonable and evidenced costs associated with a transfer or name change where permitted by law.

13.6 Baggage

Your baggage allowance will be stated in your booking confirmation or travel documentation.

Baggage allowances may vary according to the airline, fare type and services included in your package.

Additional hold luggage, cabin baggage or other baggage services are included only where expressly stated.

Customers are responsible for complying with airline baggage restrictions concerning dimensions, weight, prohibited items and restricted goods.

Charges imposed because a passenger exceeds their applicable baggage allowance are the passenger's responsibility.

13.7 Seats and optional airline services

Unless expressly included in your booking, particular aircraft seats, priority boarding, additional baggage, meals and other optional airline products are not guaranteed as part of the XCape238 package.

Where we agree to arrange an optional airline service on your behalf, additional charges may apply.

Seat allocations remain subject to the operating airline's procedures and operational requirements.

13.8 Check-in and boarding

Passengers are responsible for complying with the airline's check-in and boarding requirements.

You must arrive at the airport with sufficient time to complete check-in, security, immigration and boarding procedures.

XCape238 is not responsible where a passenger misses a flight because they:

  • arrive at the airport late;
  • fail to check in within the airline's required time;
  • fail to attend the boarding gate when required;
  • do not possess the necessary passport, visa or travel documentation; or
  • otherwise fail to comply with applicable airline, airport or immigration requirements,

except where the circumstances were caused by XCape238 or where liability cannot lawfully be excluded.

13.9 Passports and travel documentation

Every passenger is responsible for ensuring that they hold a passport and any visa, entry authorisation or other travel documentation required for their journey.

Passport validity and entry requirements can vary according to nationality and personal circumstances.

Customers should check current official travel requirements before booking and again before departure.

13.10 Missed flights

If you miss your outbound flight for reasons attributable to you, you must contact XCape238 as soon as possible.

You may be responsible for the cost of alternative travel required to reach the destination.

Missing an outbound flight does not automatically entitle you to a refund for accommodation, entertainment or other services that remain available to you.

Any entitlement to a refund will be determined by applicable law and the circumstances of the booking.

13.11 Return flights

You are responsible for checking your return flight information and any updates communicated during your trip.

Where we become aware of a material change to a flight forming part of your package, we will take reasonable steps to inform affected customers using the contact details supplied with the booking.

13.12 Airline conditions

Flights are subject to the operating airline's applicable conditions of carriage and applicable aviation law.

Where there is a conflict between an airline's conditions and mandatory consumer or package travel rights applying to your contract with XCape238, your mandatory statutory rights will not be affected.

13.13 Your statutory rights

Nothing in this Flights section excludes, restricts or reduces any rights which you have under applicable UK consumer, package travel or passenger-rights legislation and which cannot lawfully be excluded or restricted.

Back to top ↑

14. Package Travel Rights

Where the combination of services purchased by you constitutes a "package" under applicable package travel legislation, you will receive the rights and protections required by that legislation.

Where applicable, these may include rights concerning:

  • pre-contract information;
  • responsibility for performance of the package;
  • significant changes before departure;
  • cancellation and termination;
  • transfer of a package to another traveller;
  • price reductions and compensation where legally applicable;
  • assistance while travelling; and
  • applicable insolvency protection.

Where these Terms conflict with a mandatory right provided by applicable package travel legislation, the statutory right will prevail.

Back to top ↑

15. Accommodation

Accommodation is provided in the room category identified in your confirmed booking.

Images on the website are intended to give a reasonable indication of the accommodation, but individual rooms may differ in layout, outlook, furnishing or positioning.

Room occupancy limits must be observed.

Guests must comply with the hotel's rules, security procedures and reasonable instructions.

Customers are responsible for damage they deliberately or negligently cause to accommodation or hotel property, subject to applicable law.

Back to top ↑

16. All-Inclusive Food and Drinks

Where included in your package, food and drinks are provided during the advertised all-inclusive service periods.

Specific outlets, menus, brands, opening hours and availability may vary.

Alcohol will only be supplied to persons legally permitted to consume it and may be refused where required by law, hotel policy, licensing requirements, safety considerations or responsible-service policies.

The inclusion of alcoholic drinks does not create an entitlement to unlimited service irrespective of intoxication, conduct or safety.

Back to top ↑

17. Age Requirements

XCape238 is an adults-only experience.

Every guest must satisfy the applicable minimum age requirements communicated at the time of booking and any minimum age imposed by the hotel, airline, venue or applicable law.

Valid photographic identification may be required.

Back to top ↑

18. Passports, Visas and Entry Requirements

It is your responsibility to ensure that you have:

  • a valid passport;
  • any required visa or travel authorisation;
  • completed any required immigration or traveller registration;
  • paid applicable government or airport taxes where these are not expressly included;
  • complied with applicable health requirements; and
  • satisfied all entry and transit requirements relevant to your nationality and circumstances.

Travel requirements can change.

Information supplied by XCape238 regarding passports, visas, entry forms, Airport Security Tax or other travel requirements is general information only and may change between booking and travel.

You must check current official government and destination requirements before booking and again before travelling.

We are not responsible for a traveller being refused boarding or entry because that traveller has failed to meet applicable entry requirements, except where liability cannot lawfully be excluded.

Back to top ↑

19. Travel Insurance

We strongly recommend that every guest obtains comprehensive travel insurance immediately after booking.

Your policy should be appropriate for your circumstances and should, where appropriate, cover matters including:

  • cancellation;
  • medical treatment;
  • emergency repatriation;
  • missed departure;
  • baggage and personal possessions;
  • travel disruption; and
  • activities you intend to undertake.

Insurance is your responsibility unless expressly included in your booking.

Back to top ↑

20. Health, Accessibility and Special Requirements

You should notify us before booking, or as soon as reasonably possible afterwards, of any accessibility requirements or other requirements relevant to the provision of your booked services.

We will consider reasonable requests and communicate relevant requirements to suppliers where appropriate.

Where a particular requirement is essential to your ability to travel, you should obtain written confirmation that it can be accommodated before relying on it.

Back to top ↑

21. Behaviour and Safety

Guests must behave responsibly and comply with reasonable instructions from XCape238 staff, hotel staff, security personnel, airlines, transport providers and other suppliers.

We will not tolerate:

  • violence or threats;
  • harassment or abusive conduct;
  • serious disorderly behaviour;
  • possession or supply of illegal drugs;
  • deliberate damage to property;
  • conduct creating a material risk to other guests or staff; or
  • serious or repeated breaches of venue or hotel rules.

Where a guest's conduct presents a genuine safety, legal or serious operational issue, appropriate action may be taken, including removal from an event or accommodation where lawful and proportionate.

A guest removed because of their own serious misconduct will be responsible for resulting costs to the extent permitted by law.

Nothing in this section limits our obligations where we are responsible for the circumstances concerned.

Back to top ↑

22. Illegal Drugs and Prohibited Items

Guests must comply with Cape Verdean law and all applicable airport, airline, hotel and venue rules.

Illegal drugs and unlawful items are strictly prohibited.

Guests are personally responsible for understanding and complying with applicable local laws.

Back to top ↑

23. Personal Property

You are responsible for taking reasonable care of your luggage, money, passports, electronic devices and other personal belongings.

Nothing in these Terms excludes liability where doing so would be unlawful.

Where loss or damage results from a travel service forming part of a regulated package, your rights under applicable package travel legislation remain unaffected.

Back to top ↑

24. Photography and Filming

Photography and filming may take place during XCape238 for security, operational, promotional and marketing purposes.

Where images or recordings are used for promotional or marketing purposes, we will process personal data in accordance with applicable data-protection and privacy law.

Where consent is legally required for a particular use, we will obtain that consent.

Guests may be subject to reasonable restrictions on professional photography, commercial recording, drones or other recording equipment.

Back to top ↑

25. Unavoidable and Extraordinary Circumstances

Events outside reasonable control may affect the performance of travel or event services.

These may include serious adverse weather, natural disasters, epidemics, governmental action, war, civil unrest, terrorism or credible threats of terrorism, airport closure, airspace restrictions and other unavoidable and extraordinary circumstances.

Our obligations and your rights in such circumstances will be determined by applicable law, including package travel legislation where applicable.

Nothing in this section removes a right to a refund, assistance, repatriation or other remedy where applicable law provides that right.

Back to top ↑

26. Our Responsibility to You

We will provide services falling within our responsibility with reasonable care and skill.

Where we are the organiser of a package, we accept the responsibilities imposed upon package organisers by applicable legislation.

We are not responsible for losses which:

  • are caused by you;
  • arise from matters wholly outside the scope of the services we agreed to provide; or
  • may lawfully be excluded or limited under applicable legislation or international conventions.

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence where liability cannot lawfully be excluded;
  • fraud or fraudulent misrepresentation;
  • breach of statutory consumer rights which cannot legally be excluded; or
  • any other liability which cannot lawfully be excluded or limited.
Back to top ↑

27. Third-Party Suppliers

Parts of your experience may be provided by third parties including airlines, hotels, transfer operators, entertainment providers and other suppliers.

Their reasonable operational conditions may apply to the services they provide.

However, where XCape238 is legally the organiser of a package, the use of third-party suppliers does not remove any statutory responsibility imposed upon the organiser for performance of the package.

Back to top ↑

28. Complaints During Your Trip

If you experience a problem during the event or trip, please tell an XCape238 representative or the relevant supplier as soon as reasonably possible so there is an opportunity to address the issue.

For package bookings, you should notify us without undue delay of any lack of conformity you identify during performance of the package.

Failure to report an issue promptly may affect our ability to investigate or remedy it but does not remove any statutory rights you have.

Back to top ↑

29. Complaints After Travel

Complaints should be sent to:

xcapeevents238@gmail.com

Please include:

  • your full name;
  • booking reference;
  • details of the issue;
  • relevant dates;
  • supporting photographs or documents where applicable; and
  • the resolution you are seeking.

We will investigate complaints and aim to respond within a reasonable period.

Back to top ↑

30. Refunds

Where a refund is due, it will be processed using the original payment method where reasonably practicable.

Refunds required by statute will be made within the period required by applicable law.

Any voluntary refund offered outside your statutory rights may be subject to the conditions stated when that refund is offered.

Back to top ↑

31. Services Purchased from Third Parties

If you independently purchase flights, accommodation, excursions, tickets or other services which do not form part of your XCape238 booking, the contract for those services will normally be between you and the relevant third-party supplier.

XCape238 is not responsible for independently purchased arrangements except where applicable law provides otherwise.

Back to top ↑

32. Data Protection

We will process personal information in accordance with applicable UK data-protection law and our Privacy Policy.

Information may be shared with airlines, hotels, transport providers and other suppliers where reasonably necessary to administer and perform your booking or where otherwise permitted by law.

Where international transfers of personal data are required, they will be handled in accordance with applicable data-protection requirements.

Back to top ↑

33. Website Information

We take reasonable care to ensure information published on the XCape238 website is accurate.

However, programme information, travel requirements, airline information, government charges, resort details and other matters may change.

Your booking confirmation and any subsequent written amendments form the primary record of the services included in your individual booking.

Back to top ↑

34. Intellectual Property

The XCape238 name, branding, website content, artwork, graphics, photographs and other intellectual property belonging to XCape238 or its licensors may not be reproduced or commercially exploited without permission.

Back to top ↑

35. Events or Services outside the Official Programme

XCape238 is responsible only for events, activities and services which form part of the official XCape238 programme or are expressly included in your booking.

Attendance at independent events, excursions or activities organised by unrelated third parties is at your own discretion and subject to the terms of the relevant provider.

Back to top ↑

36. Severability

If any provision of these Terms is found by a court or competent authority to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.

Where appropriate, the affected provision will apply only to the maximum extent permitted by law.

Back to top ↑

37. No Waiver of Statutory Rights

Nothing in these Terms is intended to exclude, restrict or reduce any consumer right which cannot lawfully be excluded, restricted or reduced.

If there is any conflict between these Terms and a mandatory statutory consumer protection, the statutory protection will prevail.

Back to top ↑

38. Changes to These Terms

The Terms applicable to your booking are those supplied or made available to you when the booking contract is concluded, together with any subsequent change validly agreed between us.

We may update the Terms displayed on our website for future bookings.

We will not retrospectively impose a material disadvantageous change on an existing consumer booking merely by publishing new Terms online.

Back to top ↑

39. Governing Law and Courts

These Terms and your booking are governed by the laws of England and Wales, subject to any mandatory consumer protection laws applicable to you.

If you live in England or Wales, proceedings may be brought in the courts of England and Wales.

If you live elsewhere in the United Kingdom, you may also have rights to bring proceedings in the courts applicable to the part of the United Kingdom in which you live.

Nothing in this section removes any mandatory jurisdictional rights available to a consumer.
